On October 11, 2021, the Defendant was charged in Marion County case number 2021-CF-0003XX with Burglary of a Dwelling White Armed and Grand Theft. The Defense pointed out to the State that no evidence existed to place the Defendant at the scene or in possession of the stolen firearms. The State revised its previous plea offer which involved prison on the Burglary charge to dropping the Burglary charge and offering a withhold of adjudication on the Grand Theft charge. The Defense again pointed out the lack of evidence and rejected the State's amended plea offer. Subsequently, the State filed a Nolle Prosequi on January 25, 2023 dropping all charges.

On February 23, 2021, the Defendant was charged with two counts of Aggravated Assault on a Law Enforcement Officer and one count of shooting within or into an occupied vehicle in Marion Count case number 2021-CF-0004XX. During depositions, the law enforcement officer stated he was 100% positive the Defendant was the subject he observed fire the gun at him. Subsequently, the defense compiled a photo exhibit comparing the Defendant's tattoos to the tattoos of the suspect captured on video surveillance. Upon the state and law enforcement officer's review of the photo exhibit, the State filed a Nolle Presequi on August 23, 2022, dropping all charges.

On July 14, 2021 the Defendant was charged with DUI BAL > .15 in Marion County case number 2021-CT-002XXX. The Defense filed a motion to dismiss based upon the State's failure to preserve exculpatory evidence. The initial motion to dismiss was denied. Upon discovering the State's failure to preserve additional exculpatory evidence the defense field a second motion to dismiss. The second motion to dismiss was granted the morning of jury selection on July 8, 2022.

On July 16, 2021 the Defendant was arrested in Orange County case number 2021-CT-005XXX and charged with DU1 2nd Offense within 5 Years. After obtaining and reviewing the body worn camera footage of assisting officers it was discovered the testimony of the arresting officer was false. After numerous demands the State was unable to produce the body worn camera footage of the arresting officer. Based upon the arresting officers refusal to provide his body worn camera footage the State filed a Nolle Prosequi on December 1, 2021 dropping the charges.

Upon pointing out several evidentiary issues and filing a motion to suppress the State agreed to allow the Defendant to plea to the lesser charge of Reckless Driving Involving Alcohol. The plea to the lesser offense prevented an additional DL suspension.

After raising key evidentiary issues with the case the State agreed to allow the Defendant to plea to reduced charge of Reckless Driving. The reduced charge required no jail time and no driver's license suspension.
