Previous Case Results

On October 11, 2021, the Defendant was charged in Marion County case number 2021-CF-0003XX with Burglary of a Dwelling White Armed and Grand Theft. The Defense pointed out to the State that no evidence existed to place the Defendant at the scene or in possession of the stolen firearms. The State revised its previous plea offer which involved prison on the Burglary charge to dropping the Burglary charge and offering a withhold of adjudication on the Grand Theft charge. The Defense again pointed out the lack of evidence and rejected the State's amended plea offer. Subsequently, the State filed a Nolle Prosequi on January 25, 2023 dropping all charges.

On February 23, 2021, the Defendant was charged with two counts of Aggravated Assault on a Law Enforcement Officer and one count of shooting within or into an occupied vehicle in Marion Count case number 2021-CF-0004XX. During depositions, the law enforcement officer stated he was 100% positive the Defendant was the subject he observed fire the gun at him. Subsequently, the defense compiled a photo exhibit comparing the Defendant's tattoos to the tattoos of the suspect captured on video surveillance. Upon the state and law enforcement officer's review of the photo exhibit, the State filed a Nolle Presequi on August 23, 2022, dropping all charges.

On July 14, 2021 the Defendant was charged with DUI BAL > .15 in Marion County case number 2021-CT-002XXX. The Defense filed a motion to dismiss based upon the State's failure to preserve exculpatory evidence. The initial motion to dismiss was denied. Upon discovering the State's failure to preserve additional exculpatory evidence the defense field a second motion to dismiss. The second motion to dismiss was granted the morning of jury selection on July 8, 2022.

On July 16, 2021 the Defendant was arrested in Orange County case number 2021-CT-005XXX and charged with DU1 2nd Offense within 5 Years. After obtaining and reviewing the body worn camera footage of assisting officers it was discovered the testimony of the arresting officer was false. After numerous demands the State was unable to produce the body worn camera footage of the arresting officer. Based upon the arresting officers refusal to provide his body worn camera footage the State filed a Nolle Prosequi on December 1, 2021 dropping the charges.

On July 28, 2020 the Defendant was arrested in Marion County case number 2020-CF-003XXX and charged with Aggravated Battery on a Pregnant Female a second degree felony. After scheduling depositions and highlighting key evidently issues the State was forced to file a Nolle Prosequi on June 21, 2021 dropping the charges.

On August 7, 2020 the Defendant was arrested in Marion County case number 2020-CT-005XXX and charged with DUI. Subsequently the Defense filed a motion to dismiss the charges. Rather than responding and setting the motion to dismiss for a hearing the State filed a Nolle Prosequi on May 4, 2021 dropping the charges. 

On October 24, 2020 the Defendant was arrested for DUI in Orange County case number 2020-CT-001XXX. Upon the Defense setting the case for trial the State filed a Nolle Prosequi on May 3, 2021 dropping the charges. 

On November 5, 2020 the Defendant was arrest for DUI w/ one prior offense in Marion County case number 2020-CT-007XXX. Upon pointing out several evidentiary issues and filing a motion to suppress the State agreed to allow the Defendant to plea to the lesser charge of Reckless Driving Involving Alcohol. The plea to the lesser offense prevented an additional DL suspension. 

On March 3, 2020 the Defendant was arrested and charge with DUI in Marion County case number 2020-CT-001XXX. After more than a year the case as set or trial to set to commence on Monday April 26, 2021 the State filed a Nolle Prosequi dropping the charges on Friday April 23, 2021.

On September 19, 2018, the Defendant was charged with Fleeing or Attempting to Elude, a second degree felony, and DWLSR 2 Priors, a third degree felony, in Lake County case number 2018-CF-001XXX. The Defense was able to discredit the law enforcement officer's identification of the Defendant. Subsequently on March 18, 2021, the State was forced to file a Nolle Prosequi, dropping all charges.

On November 5, 2020, the Defendant was arrested in Sumter County case number 2020-CF-001XXX and charged with Battery 2nd Offense, a third degree felony. After scheduling depositions and highlighting key evidentiary issues, the State was forced to file a Nolle Prosequi on March 3, 2021, dropping the charges.

On September 18, 2020, the Defendant was arrested in Marion County case number 2020-CT-006XXX and charged with Driving Under the Influence. The Defense then filed a motion to suppress all evidence based upon the illegal arrest of the Defendant. On January 27, 2021, just days before the scheduled motion to suppress hearing, the State filed a Notice of No Information, dropping the charges.

On December 20, 2020 the Defendant was arrested for Battery/Domestic in Orange County case number 2020-MM-090XXX. After the defense highlighted the legal issues with the case the State then filed a Notice of No Information on January 4, 2021 announcing the charges had been dropped.

On October 24, 2020, the Defendant was arrested in Orange County case number 2020-CF-0128XXX and charged with Possession of a Controlled Substance, a third degree felony. After pointing at key evidentiary issues, the State filed a Notice of No Information, dropping the charge.

On August 4, 2020 the Defendant was arrested in Marion County case number 2020-MM-0053XX and charged with Battery & Resisting LEO Without Violence. Upon discovering the State failed to file charges within the time frame permitted by the rules of Speedy Trial the defense filed a Motion to Dismiss based on the violation. After receiving the Motion to Dismiss the State filed a Nolle Prosequi on the very same day announcing all charges had been dropped.

On April 11, 2020 the Defendant was arrested in Osceola County case number 2020-MM-0009XX and charged with Resisting a Law Enforcement Officer Without Violence. One day after the defense filed a Motion to Dismiss the State responded by filling a Nolle Prosequi dropping the charges.

On October 21, 2020 the Defendant was arrested for Battery in Marion County case number 2020-MM-007XXX. After the defense brought several legal issues to the attention of the State the State filed a Notice of No Information announcing the charges had been dropped.

On December 14, 2019 the Defendant was arrested in Lake County case number 2019-MM-007XXX and charged with DUI 2nd Offense inside of 5 years which carries a minimum mandatory of 10 days in jail and 5 year driver's license suspension. After raising key evidentiary issues with the case the State agreed to allow the Defendant to plea to reduced charge of Reckless Driving. The reduced charge required no jail time and no driver's license suspension.
